By using any of our audio, graphics and website services, you are agreeing to these terms of use. You agree to all terms listed on this page. Failure to abide by terms could result is cancellation of services and/or possible copyright infringement.
1. COMMERCIAL USE
1.A Player Commercial Use: Online newscast players can be used on ONE commercial website or mobile app per license unless you have specific distribution rights on your invoice. The audio file streaming from the player cannot be modified (with the exception of adding audio ads/commercial in Premium Plan). Newscast player cannot be shared, resold or placed on multiple sites unless you have reseller annual license.
1.B Newcast Commerial Use: Downloadable media zip files, streaming files can be used on ONE commercial online website or terristrial radio station with our commercial license plan unless you have specific distribution rights on your invoice. This includes modification before/middle/ or after content for commercial placement. Streaming audio feed and/or downloadable audio files can only be used for one website or app that has been registered with us and paid for prior to use unless you have specific distrubtion rights on your invoice. Live streams or any audio files cannot be shared, resold or placed on multiple sites unless you have reseller annual license. A license must be purchased for each site or app. News files cannot be available for download, this includes podcasts. Files must be streamed not downloadable.
2. MODIFICATIONS:
Modifications to any of our files is strictly prohibited unless prior approval from dailycastnews.com. This includes audio files, graphics files, players or content. This includes all personal accounts and commercial account licenses. Premium users and LP stations have the right to remove the intro of news to place their own intros. Premium users can add their own local commercials however cannot remove the ads that are in place by Dailycast. LP stations can remove the ads inserted by Dailycast with prior approval only. All newscast files can only be used for 24-hours then must be deleted. They cannot be archived, stored, or used in other productions.
3. ADVICE
The contents of Dailycastnews.com/ProDJs, LLC website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
4. CHANGE OF USE
Dailycastnews.com reserves the right to:
4.1 change or remove (temporarily or permanently) the Website, audio files, audio service or any part of it without notice and you confirm that dailycastnews.com/ProDJs, LLC shall not be liable to you for any such change, removal or discontinuation of service.
4.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
5. LINKS TO THIRD-PARTY WEBSITES
5.1 dailycastnews.com / dailycast.news Websites may include links to third party websites (excluding adult sites) that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
5.2 Dailycast News may insert a 10 - 20 second national commercial in middle of newscast to cover the cost of the news service. This commercial cannot be removed by subscribing client with exception to LP stations and special licensing clients with prior consent.
5.3 Dailycast News may include client's logos (and links to radio) to potential advertisers for proof of news distribution. By signing up for news service, you are agreeing to allow your logo/link to be posted on Dailycast's marketing material for the annual period.
6. COPYRIGHT
6.1 All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to dailycastnews.com/ProDJs, LLC or otherwise used by dailycast.news as permitted by law.
6.2 In accessing the website you agree that you will access the content solely for your commercial use or personal use based on a paid license. None of the 'authorized' content may be downloaded zip files, copied, reproduced, transmitted, stored or distributed unless a paid membership/license has been purchased. News files cannot be available for download, this includes podcasts. Files must be streamed not downloadable.
7. Services
7.1 Dailycast News is not responsible for any refund of payment if service is temporarily or permanently discontinued, is not compatible with programming, doesn't fit radio format; or any reason. All payments include setup fees, service charges, licensing, delivery, etc and are not refundable for any reason. Our payment processor charges us for refunds, that is why we do not offer refunds for any reason. Annual and monthly charges auto-renew (under the name ProDJs, LLC). You can cancel your membership for next billing cycle however refund will not be issued for current billing cycle. There are no refunds for deals/discounts.
Cancellations must be done by opening a support ticket requesting service cancellation. You must get a manual confirmation from us (via ticket) confirming cancellation. Client will be responsible for any credit card fraudulent report fees that were filed if the cancellation process was not followed. This is to prevent miscommunication. It is highly recommended to ask questions and confirm tech or billing issues and/or programming issues BEFORE ordering or canceling this service. Once account is setup, there are no refunds. The service is not transferrable.
7.2 Clients signing up for Dailycast Syndicated News services understands the setup fee, licensing fee, delivery, etc; is for one website, radio station or online stream only. Apps, terrestrial radio groups, music services, public audio systems must contact us for licensing rates. Multiple radio stations under one company name, must pay for license for each station. Lifetime offers are for the lifetime of the current version (min one year). There is no carryover to new versions unless lifetime membership was purchased within ten months of version upgrade. Discount codes are only available for one outlet. Discount codes are limited for redemption for 30-days. Discount codes are only available for the current version with no carryovers.
7.3 Clients understand that news services are Monday through Friday with (1) Good News weekend file. There are no news services on major holidays and Dailycast will do their best to remind clients at least (7) days before the holiday.
As with other news outlets, we do use high-quality AI voiceover in some of our news reports. They blend in well with the newscasts and are programmed in with short news stories. This is to help us keep costs down.
There are times when there will be technical issues, upgrades, and/or maintenance requirements that will cause us to to cancel news service for particular day(s). Dailycast will do their best to remind clients at least (14) days prior to the "scheduled" downtimes or 24-hours before the emergency downtime.
8. DISCLAIMERS AND LIMIT OF LIABILITY
8.1 The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
8.2 To the extent permitted by law, Dailycastnews.com/ProDJs, LLC will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
8.3 Dailycastnews.com/ProDJs, LLC makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
8.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of djcaa.org for death or personal injury as a result of the negligence of MicMill.com/ProDJs, LLC or that of its employees or agents.
9. INDEMNITY
You agree to indemnify and hold dailycastnews.com/ProDJs, LLC and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against dailycastnews.com/ProDJs, LLC arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
10. COMMUNICATION
By signing up for any of our media services, communication will be through email. You agree that email communication includes daily media file delivery, ticket support communication, update notifications, newsletter updates, Q&A, membership access, account transactions and all communication regarding your client account. Most membership email communications gives you the option to unsubscribe at the bottom of the email. You agree that if you unsubscribe to particular emails, you may not be notified or have access to certain important notifications.
11. SEVERANCE
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
12. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the law and you hereby submit to the exclusive jurisdiction of the courts.
